A New York judge has declared a mistrial in the rape retrial of convicted sex offender Harvey Weinstein after the jury informed him that they were deadlocked. According to a note to Judge Curtis Farber, the jurors reported that they could not reach a verdict on whether Weinstein raped former aspiring actress Jessica Mann in a Manhattan hotel in 2013.
This marked the third sex crimes trial for Weinstein, who has been behind bars since 2020 and has faced serious health issues, including a diagnosis of bone marrow cancer in 2024. Nearly a year earlier, a different New York jury also failed to reach a verdict on a charge tied to Mann’s allegations. Weinstein’s first conviction, in 2020, was for third-degree rape involving Mann, but that conviction was overturned on appeal in 2024.
Weinstein’s second trial last year saw him convicted of first-degree criminal sexual act against Miriam Haley and acquitted on a similar charge involving Kaja Sokola. During the trial, nearly 100 women accused him of sexual assault or harassment.
The jury had deliberated for approximately nine hours over three days before sending a note to Judge Farber indicating that they were unable to agree on a verdict. In response, Judge Farber stated, “I see no reason to go any further.” With the mistrial, Weinstein will likely face another trial related to the charges against him.
Weinstein’s health has become a significant concern in recent years. Following his 2024 cancer diagnosis, he has undergone treatment and has reportedly been receiving support from his family and friends while in prison.
