

A group of Global Sumud Flotilla participants, who were deported from Tel Aviv after being arrested in international waters off the coast of Gaza, arrived at Istanbul airport on Tuesday, bearing visible marks of physical mistreatment. The individuals, who had intended to break the Israeli blockade of Gaza, were intercepted by Israeli forces and allegedly subjected to violent and humiliating treatment, including physical assault and degradation.
As the flotilla members continue their journey, the international community is drawing attention to Israel’s apparent violation of the 1984 United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. The Convention, which was ratified by Israel in 1991, explicitly prohibits acts of torture, including severe physical or mental pain inflicted for purposes such as obtaining information or punishing individuals for their actions.
Critics argue that Israel’s failure to prosecute individuals responsible for the alleged torture or extradite them to face prosecution would be a clear violation of the Convention. Article 1 of the Convention defines torture as any act intentionally designed to inflict severe pain or suffering, whether physical or mental, on an individual. It also excludes pain or suffering arising from lawful sanctions.
The international community has already accused Israel of violating several key international conventions, including the 1907 Hague Convention III on the Laws of War, which prohibits attacks without a prior ultimatum and formal declaration of war. Israel has also been accused of violating the Additional Protocol (AP I) to the Geneva Conventions, which prohibits acts of perfidy, such as assassinations, and the 1984 UN Convention against Torture.
Human rights organizations and advocates are calling on Israel to investigate and prosecute those responsible for the alleged mistreatment of the Global Sumud Flotilla participants. Failure to do so, they argue, would be a clear indication of Israel’s disregard for international human rights and humanitarian law.
As the situation continues to unfold, the international community will be closely monitoring Israel’s response to these allegations and its commitment to upholding its obligations under international law.
