In a landmark decision that has sparked intense debate nationwide, the U.S. Supreme Court has ruled 6-3 to uphold a 2020 executive order issued by former President Donald Trump that restricts participation of biological males identifying as female in female-only sports competitions. The decision, which effectively maintains the ban on biological boys participating in girls’ sports at the state and national levels, is seen as a significant setback for many in the LGBTQ+ community.
At the center of the dispute was an executive order titled “Executive Order on Encouraging Federal Agencies to Address Substantial Field of Interagency or Military-Related Matters.” Section 2 of the order specifically prohibits transgender female athletes from participating in female sports if they are defined as biological males based on their sex at birth. While the order itself has been revoked, the question of whether similar state-level restrictions are unconstitutional has remained a contentious issue.
In response to these restrictions, several high-profile lawsuits were filed by organizations such as the National Women’s Law Center (NWLC) along with various LGBTQ+ advocacy groups, arguing that these laws discriminate against transgender girls and women. Conversely, many conservative groups contended that such restrictions are necessary to maintain fairness and preserve opportunities for cisgender female athletes who may be affected by increased male physical dominance in female sports.
The high-profile case of West Virginia high school student Andrea Helfgott exemplifies the controversy surrounding these bans. Ms. Helfgott, who publicly identifies as female and has undergone hormone replacement therapy, was prohibited from competing in the West Virginia state girls’ wrestling tournament in 2021 after the West Virginia House of Delegates and the Senate enacted a legislative measure in March 2021 that specifically disallowed transgender girls from participating in all-girls sports.
The U.S. Supreme Court’s decision effectively leaves the onus on state courts to determine whether to allow biological males to participate in girls’ sports. Many LGBTQ+ advocacy groups have reacted with disappointment to the outcome of this Supreme Court ruling. As Justice Sonia Sotomayor stated in her dissent, “This Court’s decision does not simply ‘refuse to resolve the issue’ – it takes a side and, in doing so, denies countless LGBTQ+ youth the chance to live truthfully.”
Many supporters see the ruling as a significant victory for the protection of women’s sports and the fairness of competition.
